Perak PAS Youth today claimed that article 72 of the Federal Constitution, has grounds enough to prove that the state PAS secretary Nizar Jamaluddin is still the rightful menteri besar (MB) of the silver state.

nizar interview parliament 261009 "This is because his removal as MB was made outside of the Perak state assembly," said the movement's secretary Raja Ahmad Al-Hiss, in a statement emailed to the media.

He explained that article 72 states that the proceedings of the state assembly of any state cannot be questioned in any court.

Ahmad further opined that the federal court, which will hear Nizar's (left) appeal next Thursday, could only be guided by the said article.

In accordance with which, he added, only a motion of no confidence tabled and voted in the state assembly can remove a sitting MB.

He stressed that such a decision which is solely within the assembly's purview must be approved by it and cannot be decided upon by an outside power.

Ahmad was probably referring to the decision by Sultan Azlan Shah of Perak, whose unprecedented ‘meddling' in the affairs of the civil government saw him ordering Nizar to vacate his post as MB.

This is something unheard of in Malaysia's Constitutional Monarchy that separates the powers and purview of the civil government and the monarchy.

‘Full confidence in judges'

Ahmad also said that the movement has full confidence that the judges, given the mandate to make the decision on behalf of the rakyat of Perak, will "make a fair and just decision for the sake of democracy in our much beloved country".

He believed that the decision made by the judges will be an historic event before the eyes of the rakyat and indeed, the world.

On May 11, High Court judge Abdul Aziz Abdul Rahim declared Nizar, who is PAS Perak secretary, as the rightful menteri besar .

NONE However, on appeal at the Court of Appeal, rival Zambry Abdul Kadir (right) from BN was granted a stay within less than 24 hours by justice Ramly Ali, who had been elevated in April.

This was followed with the appellate court's decision on May 22, which overturned the High Court's decision and acknowledged Zambry as the legitimate MB.

Nizar had also faced problems in filing for a stay at the Federal Court following the appellate court's decision. The written judgments were only made available on June 27, a month after the oral decision of the three-member bench.

Ahmad called upon the rakyat to pray for and help ensure that the decision to be announced by the court will side with the truth and be a just one.
