The Kota Bharu High Court today allowed an application by Tanah Merah Umno division chief Ikmal Hisham Abdul Aziz and deputy chief Baharuddin Yusoff to set aside an injunction restraining them from making any transaction on the division's assets or properties.

Justice Ahmad Zaidi Ibrahim, in making the decision in chambers, also ordered the plaintiff, the division's secretary, Amran Abdul Rahman, to pay them RM10,000 costs.

Their counsel, Abu Bakar Isa Ramat, told reporters that the court also dismissed the originating summons filed by Amran after taking into account that Amran had lost his post in Umno when the application was made.

The injunction was issued by the court on Feb 16 following an application by Amran on the ground that Ikmal Hisham and Baharuddin had contravened the Societies Act 1966 when they discharged their duties in an Umno branch which had been dissolved.

Land and bank accounts

It restrained them, whether on their own, or through their agents or representatives, from conducting any transactions on eight pieces of land in Bandar Tanah Merah or making any withdrawals from Umno's bank accounts with Maybank and Public Bank in Tanah Merah.

They were represented by Wan Jawahir Haron. Amran and Ikmal Hisham were not in court.

Baharuddin, when met by reporters, said he was thankful for the decision which proved that he and Ikmal Hisham were the legitimate head and deputy head of the division.
