The Sodomy II trial is set to resume on Oct 14 and 15, following accused Anwar Ibrahim’s failure to have the charge struck out on appeal yesterday.

Kuala Lumpur H NONE igh Court judge Justice Mohamad Zabidin Mohd Diah (left) fixed the dates when the case came up for mention this morning.

He also fixed Oct 25-29, Nov 22-26 and Dec 6-10 as other dates for continuation of the trial.

The proceedings will resume with the cross-examination of Kuala Lumpur Hospital doctor Dr Razali Ibrahim.

Defence lawyer Sankara Nair said the sessions will be from 8.30am to 2pm daily to accommodate the next parliamentary session from Oct 11 to Dec 11.

Sankara also said the legal team is filing an application today to the Federal Court for leave (permission) to appeal the Court of Appeal ruling. The right to appeal to the apex court is not an automatic right.

Also appearing for Anwar is lawyer Karpal Singh, while solicitor-general II Mohd Yusof Zainal Abiden and DPPs Nordin Hassan and CK Wong make up the prosecution team.

Yesterday, a three-member panel of the Court of Appeal had unanimously ruled that it does not have jurisdiction to entertain Anwar's appeal to strike out the sodomy charge.

NONE Anwar had based his application on a claim that Saiful Bukhari (right in photo) and DPP Farah Azlina Latif were involved in a liaison of a personal nature that may have compromised the sodomy trial.

Neither has contested the allegation to date, although the Attorney-General’s Chambers has explained that Farah was not directly involved in decisions involving the trial, and that she did not have access to documents.

She has since been dropped from the prosecution team as well as dropped from the Prosecution Division of the AG’s Chambers.

On Aug 16, High Court judge Justice Mohamad Zabidin Mohd Diah had dismissed lead counsel Karpal Singh's striking-out application when he ruled that the alleged affair does not compromise the prosecution's case against Anwar.

Anwar, 63, is charged with sodomising former personal aide Saiful Bukhari on June 26, 2008, at the Desa Damansara condominium in Bukit Damansara, Kuala Lumpur.
