NUBE missing funds case to be heard tomorrow
The Kuala Lumpur High Court will hear the committal proceedings tomorrow against 15 National Union of Bank Employees (NUBE) members and former officials as well as their lawyer who had withdrawn RM1.2 million from the union's accounts.
The proceedings were originally scheduled for this morning. However, the case management judge of the civil division James Foong had changed the date to enable Judge Azmel Maamor to hear the case.
NUBE president Abdul Jalil Abdul Hamid said the proceedings were on the grounds that the 15 had breached a court order dated Feb 28 to return the money.
He said the 15 had also misused a interim order which prevented the NUBE elected officials from handling the union's accounts to withdraw the RM1.2 million in the first place.
"The 15 and their solicitor D Kalaimany from Messrs Kalai and Partners had obtained the (interim) order on Feb 22 by practising a deception on the courts," claimed Abdul Jalil.

Interim order
The 15 include eight NUBE members Nor Azlan Abd Hamid, Arnold Owen Rodriguese, Zainudin Sies, Nor Azman Abd Rahman, Mohd Zan Majid, Zulfazli Johari and Mohd Raduan Abdul Kadir.
The other seven are expelled and suspended former NUBE officials - Muhammad Fauzi Shamsuddin, A Prathibaraj Arunasalam, Abd Malek Daud, Mohd Azhar Yusof, S Kandaiyah, Mohd Noor Basir, Jamal-ud-deen Nasir Khan and Toh Seng Hock.
Muhammad Fauzi was the union president before the in-fighting saw a rival team member, union general secretary J Solomon ousted in October 2001.
Solomon was granted an injunction by the Kuala Lumpur high court returning him as the general secretary last year. Both factions led by Muhammad Fauzi and Abdul Jalil respectively have since continued to lay claim to the union leadership.
On Feb 22, after obtaining an interim order to stop NUBE elected officials from managing the union's accounts, Muhammad Fauzi's faction walked away with RM1.2 million from two banks.
They claimed this was to stop the other faction from misusing the money and alleged that Abdul Jalil's people were using a branch's account illegally for their expenses.
As at this afternoon, Muhammad Fauzi's faction had returned only RM602,056.25 out of RM614,088.40 in the NUBE account in Bumiputera Commerce Bank. Another RM654,060 withdrawn from the Ambank Bhd has yet to be returned.
