Anwar to apply to disqualify judge

Anonymous: The more I read, the more angry I become because of the blatant injustice. If there is genuine evidence, why the secrecy? Why the denial to the defence team to view the medical reports.

Something is very wrong. Why don't they just shoot Anwar Ibrahim instead of having this trial for all the world to see how Malaysia's judicial system has failed?

Josephine: Whether true or not, one cannot be faulted in thinking that the clinical notes contain information that is detrimental to the prosecution case. Anyway, going by precedent, it is pointless to expect the court or the doctors to pave the way for this document to be unveiled.

Three: As far as I am concerned as a layman, a witness will surely refer to his notes or whatever to ensure he says the 'right thing' and is consistent at all times. It is very curious that these witnesses refused to refer to their notes or written evidence.

In doing so, the 'conspiracy theory' against Anwar has is more credible now.

Big Picture: This is a total humiliation to all Malaysians. It's also a total shame that Malaysians allow this case to be prolonged so the world can continue to laugh at us. For the second time around, such despicable ‘fitnah' is thrown at an innocent victim.

A person is innocent until proven guilty beyond any reasonable doubt, so the maxim goes. The unique thing in Malaysia is that a person is guilty - as decided beforehand by the judge and the prosecutor - until proven innocent.

In countries like the Philippines (1986) and Indonesia (1998), the people went to the streets and demanded change, but not in Malaysia. Many still fear change.

Miss: Senang juga jadi hakim, ya? Duduk dengar sahaja. Tak payah baca, periksa atau analisa. Bagus la tuan-tuan - ramai nanti anak-anak muda ikut jejak langkah anda, selain mengikut jejak langkah Khir ‘Tempe' Toyo - doktor gigi yang ada resort-style mansion. Ternyata mereka semua ini orang fasik.

Heidegger & Derrida: It all boils down to this: there are two sets of evidence - one primary and the other secondary. The defence wants the primary, while the prosecution is hell-bent on suppressing it.

From this alone, we know that the primary evidence will absolve Anwar Ibrahim and the case ought to be thrown out without further ado. Hence, these doctors are coming out with their 'doctored' secondary reports instead.

The fact that the judge allows this nonsense to go on renders him unfit to carry on, and the defence is doing the right thing to have him disqualified. Not that we can expect miracles, but this is the next best move for now.

Orang: PAS should learn from this episode. Please stop talking about ‘hudud' law until all the kangaroo judges are taken off our kangaroo courts. If not, one fine day, PAS president Abdul Hadi Awang will find his hand amputated in a kangaroo judgment passed by a kangaroo judge.

Aku Melayu: Bravo, Yang Arif Mohamad Zabidin Diah. You have done an excellent job. You are the judge, not the defence team. Don't be intimidated by them. God is with you.

Karpal Singh, you can go on changing the judges. What is right is right and what is wrong is still wrong. You can buy all the time you want but you cannot buy an innocent judgment to replace a guilty verdict from God. Don't waste the people's time and money.

CarL: Macam-macam ada. The defence will do anything to continue to delay Anwar's trial. Well, it is a good test case for the prosecution. They will learn every trick in the book to delay a trial and be prepared for such cases next time.

Victor Johan: Why are these doctors prosecution witnesses when they are merely ‘specimen collectors'? Even the hospital assistant, perhaps even the hospital attendant, can collect the specimen.

The chemist only analyses the specimen collected? Now even the doctors are playing the 'tai chi game' of passing the buck. The judge should throw out the entire case, with costs.

Xroy: A judge allowing a doctor to give evidence from memory? Is it not his job to ensure that he gets to the bottom of the truth? Is this judge allowing witnesses to say what they have been told rather then seeking the truth? What justice is this?

This judge does not seem interested in the truth, he is bent on finding Anwar Ibrahim guilty. It is not only the judge, it is the prosecution and all the government doctors as well.

Chipmunk: Solicitor-general II Mohd Yusof Zainal Abiden is a panel member of the advisors to the Law Faculty, Universiti Kebangsaan Malaysia, since Aug 10, 2007. I sympathise with the law faculty students from UKM who will be learning nothing from this so-called 'learned' lawyer. All this can only happen in the ‘kangaroo courts' of Malaysia.

FairMind: The judge and the prosecutor are seen aiding the doctor in not referring to the clinical reports as much as possible. It's all so comical - no wonder the foreign specialist, Dr David Wells, is seen holding his head in disbelief.

A doctor's job is to give as much and as accurate information as possible. A doctor's job is to be impartial and not indulge in politics. If Dr Siew Sheue Feng wants to indulge in politics, he should join MCA.

Tok Janggut: I always thought that in any court case, a judge would want all documents which are related or relevant to the case to be put forward as exhibits for both parties to argue on because the judge would always want the truth, anything but the truth. Then only, if any documents is found irrelevant, the judge will then decide to scrap that particular evidence.

But in our court, it looks like the judge has already decided which document is relevant and which is not. What is the basis of this decision? It looks like anything that can give advantage to the defendant will automatically be classified as irrelevant.

Therefore, this is turning into a court case between Anwar and the judge, not Anwar against the complainant, Mohd Saiful Bukhari Azlan.
