The High Court in Kuala Lumpur today set Dec 23 for case management on the suit by Adam Kadir against Pos Malaysia Berhad and two others concerning his dismissal as non-executive chairman of Pos Malaysia Berhad, two years ago.

Judge Dr Prasad Sandosham Abraham made the decision in chambers after a meeting with lawyer Mohamed Hanipa Maidin, representing Adam, lawyer Megat Abdul Munir Megat Abdullah Rafaie, representing Pos Malaysia Berhad, and federal counsel Najwa Bistaman, representing the Malaysian Finance Minister and the Malaysian government.

Najwa, when approached by journalists, said that the date was set to enable both the plaintiff and defendant to file their defence.

In the suit filed on Oct 22, Adam, 68, was seeking a declaration that the termination of his contract or dismissal as non-executive chairman of the company by the third defendant, namely the Malaysian government through the second defendant (Malaysian Finance Minister) was a breach of contract which was null and void.

He also sought a declaration that his termination and dismissal was unconstitutional and contradicted Article 5(1) of the Federal Constitution.

In addition, Adam also sought special damages, general damages, exemplary damages and aggravated damages.
