The DAP received a certain percentage from payments for Selangor government projects, a senior Malaysian Anti-Corruption Commission (MACC) officer revealed today.

Four companies that were paid with allocations from the Seri Kembangan constituency had each contributed to a DAP branch in Serdang Aman and DAP Malaysia, MACC Selangor investigations unit chief Hairul Ilham Hamzah said.

In some cases, DAP was given a 30 percent cut, Hairul told the royal commission of inquiry investigating the death of Teoh Beng Hock, who was political secretary to Seri Kembangan assemblyperson Ean Yong Hian Wah.

The Selangor MACC was investigating allegations of state funds misappropriation by Ean Yong and other state assemblypersons when Teoh was taken in as a witness on July 15, 2009.

Teoh was found dead the next day on the fifth floor service corridor of Plaza Masalam, where the Selangor MACC office is located on the 14th floor.

It was previously noted that Teoh, a witness in the anti-graft authority's probe, was suspected of drafting four incomplete invoices for several companies.

The MACC had gone to Ean Yong's office looking for payment vouchers to substantiate the documents found at the Petaling Land and District Office, suspecting that he had misappropriated funds allocated for his constituency.

According to MACC lawyer Muhammad Shafee Abdullah, three of the four companies that were paid contributed five to nearly 30 percent to a DAP branch, while the other contributed one-third of its payment to the party headquarters.

In the documents pertaining to claims produced today, Hairul said Hong Chye Enterprise, which organised a lantern festival for children in 2008, was paid RM10,000, out of which RM3,000 went to the DAP's Serdang Aman branch.

Contractor used names of various companies

These projects were carried out by contractor Lee Wye Wing under the names of various companies, which were also given a portion of the payment for the use of their company names.

One of these companies is WSK Services, which completed projects for three other claims.

WSK was allocated RM4,200 for a similar lantern festival, of which RM3,754.76 was paid to DAP Serdang Aman branch, Hairul said.

The company had also organised a delegation of voters from the Kampung Tunku constituency to visit the state assembly and was paid RM1,800 for this, with one-third of the sum RM600 channelled to DAP Malaysia.

For a function involving WSK on solidarity in support of Seputeh parliamentarian and Kinrara assemblyperson Teresa Kok, they were given RM1,665, of which RM379.15 was directed to DAP Serdang Aman.

NONE More suspicions, arose when part of this payment, RM1119.35, was also paid to Hong Chye Enterprise and of this, Hong Chye dispersed RM112 to "Beng Hock" and RM1007.35 into an "unknown fund", Hairul said.

Questioned by chief commissioner Justice James Foong ( left ) about the unknown fund, Hairul said his team never had the opportunity to probe the matter because the MACC headquarters had directed the Putrajaya team to take over the case.

"It was after Teoh's death and we were off the case," he said.

Foong, who was rather puzzled and asked why the officer did not immediately check on the details of the fund, since Hairul said the MACC had also questioned Lee at its office the night Teoh was interviewed.

Hairul ticked off for blaming MACC headquarters

Hairul urged the commission to understand that the matter was no longer in MACC Selangor's purview, but Foong ticked him off, saying a person in his position should not "blame the headquarters for everything".

"After Teoh's death, the whole operation and the MACC Selangor branch became paralysed. Every officer was afraid to work," Hairul said.

Lee Wye Wing his police statement said he had drafted the four "incomplete" invoices found in Teoh's laptop although he was unsure if he had emailed some of them to Teoh.

The contractor had also said that in one invoice from the laptop, which he had prepared for a project costing at RM18,750, it was instead drafted for RM12,198.90 but he did not know why it was listed at a lesser value.

Hairul said last week Teoh was suspected of creating fake invoices for state government projects in Seri Kembangan, since they were found in the political aide's laptop.

It was also clarified that upon investigations into four companies, they had told the MACC that they did not perform the projects as listed, Hairul had said.

The inquiry continues tomorrow.
