Selangor legislative assembly speaker Teng Chang Khim called on attorney-general Abdul Gani Patail today to take action against the wife of former state menteri besar Dr Mohd Khir Toyo.

zaharah kechik Teng said Zaharah Kechik ( right ) did not present herself when summoned by the assembly's Select Committee on Competency, Accountability and Transperancy (Selcat) to testify as a witness in its public inquiry into the controversial funding of the Wives of Selangor Assemblypersons and MPs Welfare and Charity Organisation (Balkis).

This happened in Selcat’s first term when she (Zaharah) was called as a witness but did not appear, said Teng.

“This is an offence under the Contempt of the State Assembly Enactment 2009, which has been recognised by the court as a valid law.

“For this, I call on the attorney-general to take action against her for violating the provisions of the Contempt of the State Assembly Enactment.

“There is nothing doubtful (on the matter) that stops them from enforcing the law,” Teng told a press conference at his office today.

Teng, who is Sungai Pinang assemblyperson, was referring to a declaration by the Shah Alam High Court yesterday recognising Selcat as a valid committee in the eyes of the law.

NONE Teng ( second from right ) said the Shah Alam High Court had also ruled that decisions made during a sitting of the assembly cannot be challenged by any court.

“The court agreed that the decision made by the state assembly is protected under Article 72 and Article 77 of the federal constitution,” he added.

The declaration quashes thereby a civil suit by three BN state representatives seeking to obtain a court ruling to declare Selcat as an illegal committee.

The three assemblypersons are Raja Ideris Raja Ahmad, Hasiman Sidom and Wong Koon Mun.

NONE On another matter, Teng said he has still not received the court notice over the status of the Port Klang state seat won by Badrul Hisham Abdullah ( right ) on March 8, 2008.

Teng said this when asked whether the former PKR assemblyperson would be allowed to attend the upcoming assembly sitting this March 28.

“As of now, we have not accepted any court order stating that he (Badrul Hisham) is still a state assemblyperson.

“But who knows? Maybe I will be issued a notice this Friday,” he added.

The Shah Alam High Court on Feb 18 ruled that Badrul Hisham - who Teng said had missed six months of attendance at the state assembly - was still the Port Klang state legislator .

The ruling quashed an earlier notice by Teng declaring the seat vacant.

Unsatisfied with the declaration, Teng has applied to set aside the ruling.
