Judge Slamat Yahya set the date after allowing an application by Edmond Bon, representing Shuhaimi, 42, today.
Bon had applied for a new mention date to allow the defendant to file an application at the High Court seeking a declaration that the Sedition Act 1948 contravened Articles 5, 8 and 10 of the Federal Constitution.
The PKR assemblyman is charged with publishing a seditious article in his blog on Dec 30, last year.
He can be jailed up to three years or fined up to RM5,000 if found guilty under Section 4 of the Sedition Act 1948.
He was alleged to have committed the offence at Pusat Khidmat Rakyat, 6/2, Jalan Anggerik Vanilla R 31/R, Kota Kemuning, here.
Earlier Deputy Public Prosecutor Mohamad Hanafiah Zakaria applied to the court to issue a warrant of arrest against Shuhaimi for not being present at the court at 9am.
Bon however said that they had informed the court that Shuhaimi had to attend the opening of the Selangor state legislative assembly by the Sultan of Selangor and asked for the court to stand down to have the accused present in court.
Slamat allowed the application.
Shuhaimi later arrived at the about 10.05am, in his official legislative attire.
