The lawyer who represented Port Klang Assemblyman Badrul Hisham Abdullah in court, Mohd Hafarizam Harun, today filed an originating summons to quash a decision by the selangor legislative assembly to compel him to appear before the House Rights and Privileges

Committee this Friday to answer charges for contempt of the assembly.    

Mohd Hafarizam, 39, filed the suit through the legal firm of Messrs Hafarizam Wan & Aisha Mubarak at the High Court registry in Shah Alam.

The suit named the selangor legislative assembly, the House Rights and Privileges Committee secretary Mohamad Yasid Bidin and the committee as defendants.

Mohd Hafarizam is seeking a declaration that the summons notice, dated last April 12, issued by Mohamad Yasid, in ordering him to attend before the committee contradicted the federal constitution and the Selangor state constitution.

He is also seeking a declaration that the summons was ultra vires of the Selangor state constitution and the schedule on the powers and privileges of the state legislative assembly, the Selangor state assembly standing order and the Contempt of the House (State of Selangor) Enactment 2009.

He is also seeking a declaration that his action in sending a letter to the state assembly for costs of a court case of his client as ordered by the court, was not a contempt of the assembly, and as such for an order that there was no need for him to appear before the committee.

Met by reporters later, Mohd Hafarizam said his application would be heard at 9am this Friday.
