Court rules Nazri not in contempt for 'liar' remark

Paul Warren: It looks like Karpal Singh does not know the law as it is practised in Malaysia.

When Karpal said, "The court took judicial notice that it cannot find proof that Malaysiakini is an electronic media, and we are perplexed with this finding," he obviously ignored the position of the judges in these types of cases.

From everything that I have seen in the past, the judge has been required to leave any iota of intelligence and common sense behind when he ascends the bench. In this case, the outcome required was the dismissal of the case.

Any sentence at all that is said in good language (English in this case) that conjures up an excuse is good enough. That provides the basis for the outcome. It does not need credentials nor has it to make sense. The judge just says it, takes it that it provides the basis and dismisses the case.

For example, the judge could say that it is not raining because he did not get wet and he is not wet. Who is to argue with that?

Michael Celo: Even a High Court judge cannot find evidence that Malaysiakini is electronic media? Does he mean to say now that everything published on the Internet cannot become, nor be called, ‘evidence'?

If that's the case, does it mean that what MCMC (Malaysian Communications and Multimedia Commission) and Rais Yatim said previously - that statements made against the government/BN/ Umno made online in the Internet by online media and bloggers - cannot now be ‘evidence' enough for any government action, under whatever acts, to be taken against these media/bloggers?

Whoopee! Now that's the online freedom all Malaysians want. Thanks, justice Akhtar Tahir. By the way, anyone knows whether the judge has a computer and Internet connection?

Joker: Judges now do not even make an effort to come up with reasons that at least seem to make some sense.

He does not see any evidence that Malaysiakini is an electronic media when Malaysiakini is only available via the Internet as its application for a newspaper has been rejected.

Meranti Kepong: The judge in this case is bias and his judgment is in grave error. His denial of truth is totally incomprehensible and partisan. His judgment is designed to favour BN-Umno, which has the power to remove him if his judgment displeases it.

PM Najib Razak's boast of good governance is nothing but an absolute fiction. Indeed, our country is politically going to the dogs.

Ferd Tan: It's irrelevant whether the judge in this case is right or wrong. It's makes no difference. From the public perception, justice from the Malaysian judiciary is dead. Nothing can be done until a revolution of the whole judiciary system occurs - of course, it is only possible with a change of government.

Keturunan Malaysia: My parents used to protect, defend and said that I did the right thing whenever I quarrelled with other kids, when most of the times, if not virtually all of the time, I was to be blamed.

After some time, they had had enough and gave me as many strokes of canning as I cared to remember. I changed. My younger brothers and sisters changed and followed my examples. My neighbours' kids changed (they started liking, playing and going around with me).

We need to change Umno/BN and people like this judge and, not the least, Nazri too. Only then will we have the change we desire and need badly.
