The High Court was today told that a resident of a flat at Subang Jaya, known as “Awang”, had called the police to inform about the presence of a black BMW X5 car at the parking area of the flat on the day cosmetics millionair Sosilawati Lawiya was reported missing.

Sergeant Jaswant Singh, 52, said he received the call from a resident of the flat, only known as Awang, between 8.45pm and 8.50pm while he was on duty as supervisor at the Subang Jaya police operations room on Sept 6, 2010.

“I was informed by Encik Awang that he saw the BMW car, with registration number WTL 11, at the car park of the Angsana flat, Pangsapuri USJ, Subang Jaya.

“Following which, I instructed members from the MPV (police patrol car) unit to go to the scene to check whether the vehicle was there,” he said during examination-in-chief by deputy public prosecutor Saiful Edris Zainuddin.

Jaswant Singh, who is the 18th prosecution witness, was testifying in the trial of former lawyer N Pathmanabhan and three farm workers, T Thilaiyagan, R Matan and R Khatavarayan pleaded not guilty to killing Sosilawati, 47, bank officer Noorhisham Mohamad, 38, lawyer Ahmad Kamil Abdul Karim, 32, and Sosilawati’s driver Kamaruddin Shamsuddin, 44, at Lot 2001, Jalan Tanjong Layang, Tanjong Sepat, Banting, between 8.30pm and 9.40pm on Aug 30, 2010.

    

Pathmanabhan, 42, Thilaiyagan, 20, Matan, 21, and Khatavarayan, 31, were charged under Section 302 of the Penal Code which was read together with Section 34 of the same act which provided for the mandatory death sentence upon conviction.

Jaswant Singh said he also informed the Subang Jaya deputy police chief, all division heads and the Selangor police headquarters on the discovery of the car and then waited for further instructions.

NONE When cross-examined by lawyer Amer Hamzah Arshad, who represented Matan, he said he did not record Awang’s full name, his identity card number nor his address.

Amer Hamzah: Did Awang say how long had the car been there?

Jaswant Singh: Awang said the car had been there for some time, but he only realised (the car belonged to Sosilawati) ( right ) after watching the news on television.

Meanwhile, 19th prosecution witness, Lance Corporal Roslee Sharon, 30, said that on Sept 6, 2010, he received instruction from the Subang Jaya police operations room to find a black BMY car, with registration number AAJ 5 belonging to Ahmad Kamil, which was at a location near the Grand Dorsett Hotel, Subang Jaya.

Roslee, who was then with the MPV unit, said the team finally found the car at a car park at Lot 125, Jalan SS15/1B, Subang Jaya.

“The MPV driver, Lance Corporal Faizal Ismail and I saw the car, which was parked haphazardly, and then informed the operations room, the station chief and were then instructed to wait for the Forensic Unit to arrive and told not to touch the car.

“We also cordoned off the area,” he said, adding that they only left the location at about 2.30am after the forensic team had completed their investigation there.

Fifth prosecution witness, Lance Corporal Kasmir Luntuk, 25, who was called back to testify, said he was instructed by Dr Nurliza Abdullah to take 145 pictures of bone pieces in the autopsy room of the Kuala Lumpur Hospital (HKL) on Sept 17, 2010.

        

Kasmir, a photographer at the Dang Wangi police headquarters, said the task took him a day, from 8.30am to 8pm, and that he printed the pictures the following day (Sept 18, 2010) at the Kuala Lumpur police photo unit.

He said the picture were then handed over to investigating officer ASP Ishak Yaacob a week later.

The 17th prosecution witness, Corporal K Manikam, 53, said he was instructed by Ishak to take four picture of a mobile phone on Sept 14, 2010.

Manikam, also a photographer at the Dang Wangi police headquarters, said he was also instructed to snap 165 pictures of bone pieces at the HKL autopsy room on Sept 18, 2010.

The hearing before judge Akhtar Tahir continues on Monday.
