The Kuala Lumpur Magistrate's Court today fixed Aug 17 for decision on a drug case involving actor Khaeryll Benjamin Ibrahim, who is also known as Benjy.

Magistrate Hafizza Sauni made the decision after hearing submissions from both parties.

Lawyer Amer Hamzah Arshad, who represented Benjy, submitted that his client was not at home on the day of the incident and that the drug was not his.

He said that from Benjy's personal assistant Afifi Hamid's testimony, their friend Nor Azizi had left the packet containing the drug on the book shelf after waiting for Benjy for an hour.

However, deputy public prosecutor Noor Mawarni Andul Halim submitted that the testimony by Benjy and Affi was merely fictitious as the matter was never raised during the prosecution's case.

He said had Nor Azizi existed and he had placed the drug on the book shelf, Afifi should have informed the matter during the early stage of investigation.

Noor Mawarni said the story about Nor Azizi only cropped up when Benjy was called to enter his defence and Afifi called back to testify in court.

She also said Amer Hamzah's submission that Benjy went fishing on March 10 and 11, 2010, was baseless because there was no evidence submitted.

She said Benjy was at home on that day and that the drug which he surrendered to the police was his.

On July 8, Benjy was ordered to enter his defence on a charge with possession of 0.24 grammes of syabu at his residence, A-6-5 Menara Duta 2, Jalan 1/38B, Persimpangan Jalan Segambut, at 4 pm on March 11 2010.

He was charged under Section 12(2) of the Dangerous Drugs Act 1952 which carries a maximum fine of RM100,000 or imprisonment up to five years upon conviction.
