The police corporal sentenced to five years jail after he was found guilty of causing the death of the 15-year-old Aminulrasyid Amzah, has filed an appeal against his conviction and sentence.

Jenain Subi, through his lawyers, Salim Bashir and Halim Ashgar Mohd Hilmi, filed the appeal at the Shah Alam High Court registry at around 12.45pm today.

Speaking to reporters at the court, the police corporal said he was dissatisfied with the decision made by the Sessions Court judge, Latifah Mohd Tahar, and had filed the appeal in a bid to clear his name.

Latifah, had on Sept 15, handed down the sentence on Jenain, 49, after finding him guilty of causing the death of Aminulrasyid between 1.10am and 2am on April 26, 2010 at Jalan Tarian 11/2 in Section 11 in Shah Alam.

However, the judge also granted him a stay of execution of the sentence pending appeal.

Meanwhile, deputy public prosecutor Idham Abd Ghani, when contacted by Bernama , said that the prosecution had also filed a cross appeal on the sentence passed by the Sessions Court, today.

Jenain was charged under Section 304(a) of the Penal Code which carries a maximum jail term of 30 years and fine.

Aminulrasyid died of a gunshot wound to the head.
