The High Court in George Town today set Dec 8 to decide on an application by the Penang Islamic Religious Council (MAINPP) to remove a caveat entered by a beneficiary of an endowment land at Jalan Mengkuang, Bagan Luar, Butterworth.

Justice Yaakob Md Sam fixed the date after hearing submissions from both parties, with the beneficiary of the endowment land, Muhamad Amin Abdul Rahman, 38, represented by lawyer Raj Shanker, and MAINPP, represented by lawyer Mohd Aslam Mohd  Mydin.

Mohd Aslam submitted that MAINPP had the right to order all the 14 families occupying the 1.1 hectare land to vacate the site to make way for the construction of a 22-storey apartment building.

He said Muhamad Amin, a billboard installer, had no right to object to the development of the land due to his status as a beneficiary who received revenue from the endowment land.

Meanwhile, Raj said that MAINPP was only the administrator of the land and did not have the right to order the affected families to evict the site or to carry out development there.

On Aug 17, 1892, Kavana Ebrahim @ Burong had bequeathed his 1.1 hectare land at Jalan Mengkuang, Bagan Luar, Butterworth to Muslims staying in the area.
