Five individuals were jailed a day and fined RM2,000 each by the Sessions Court in Kuala Lumpur today for participating in an illegal assembly relating to the repeal of the Internal Security Act (ISA), three years ago.

Judge Ainul Shahrin Mohamad in meting out the sentence to Mohamad Sukri Mohamad Sirat, 27, Syaza Muaz Shaharudin, 22, Norazam Sakib, 47, Zul Sifli Kamma Kutty, 26, and Hayati Abd Samad, 62, ruled that the defence had failed to dent the prosecution’s case.

She, however, allowed a stay of execution of the jail sentence pending their appeal to the High Court.

The five had committed the offence in the vicinity of Masjid Negara in Kuala Lumpur between 9am and 11am on Aug 1, 2009 and were charged under Section 27 (5) (a) of the Police Act 1967, punishable under Section 27 (8) of the same Code, which carries a maximum one year’s jail and a fine of not more than RM10,000 upon conviction.

All five paid their fine.

Deputy public prosecutor Yusaini Amer Abdul Karim prosecuted while counsel Azizul Shariman Mat Yusoff led the defence team.

On Feb 22, 11 individuals were jailed a day and fined RM2,000 each by the same court for a similar offence.
