Businessman Shamsubahrin Ismail was discharged not amounting to an acquittal by the magistrate’s court in Shah Alam today on a charge of cheating a woman of RM13,000 July last year.

This is the second time Shamsubahrin has been discharged without an acquittal for a cheating charge.

Magistrate Nurul Syahida Zainal made the decision after being informed by DPP Noor Husnita Mohd Radzi that she was instructed to withdraw the charge against Shamsubahrin, 46.  

The businessman allegedly deceived Aina Noridar Abdullah, 45, into depositing RM13,000 into his Maybank account in July 2011, for the supply of two non-existent maids.   

He faced up to five years in prison or fine or both under Section 417 of the Penal Code, upon conviction.   

The first time he was discharged without an acquittal on a charge of cheating a taxi driver was on April 12 this year, after the prosecution withdrew the charge.    

Shamsubahrin is also facing two charges at the Kuala Lumpur Sessions Court of cheating National Feedlot Corporation (NFC) chairperson Dr Mohamad Salleh Ismail of RM1.755 million.  

The case was set for re-mention on May 21.
