Television personality Ras Adiba Mohd Radzi today denied having been responsible for the restructuring and reinforcing of Inki Plas Holdings Sdn Bhd over which she is being sued.

She further claimed that the plaintiff, Nik Fauzi Nik Hussein, made a false representation with regard to the machine for recycling low density polyethylene waste, when it was actually not in the company’s possession.  

In her counterclaim, she is seeking a cancellation of a share sale and purchase agreement contract dated July 24, 2006, compensation and other relief.

The case, heard before Justice Nallini Pathmanathan in chambers, has been fixed for hearing from Oct 8 to 10.

Nik Fauzi filed the RM3.2-million suit against Ras Adiba on May 3, claiming breach of the share sale-and-purchase agreement contract.

In his statement of claim, he said he had a 65 percent share in Inki Plas Holdings Sdn Bhd and had agreed to sell all the shares to the defendant.

According to him, on July 24, 2006, he and the defendant signed a share sale-and-purchase agreement contract, which was stamped on Aug 2, 2006.

He claimed Ras Adiba had power and control over the restructuring of the company, hence her purpose of buying the shares.

Nik Fauzi also claimed that Ras Adiba had neglected and failed to help reinforce the company, causing it to face financial difficulties.

He claimed that she should have settled the company’s liabilities totalling RM3.2 million but failed to do so and had therefore breached the agreement contract.
