The High Court in Kuala Lumpur has fixed Oct 8 and 9 to hear the suit filed by the sultan of Kelantan’s brother Tengku Muhammad Fakhry Petra against inspector-general of police Ismail Omar and three others over his alleged wrongful detention in August 2009.

Justice Zabariah Mohd Yusof fixed the date in chambers today.

The plaintiff filed the RM150 million suit on Dec 9 last year, naming Ismail, the Kelantan sultan’s chief personal bodyguard ASP Norazman Ismail, Kelantan police chief Abdul Rahim Hanafi and the Royal Malaysia Police as the first to fourth defendants, respectively.

NONE In his statement of claim, Tengku Muhammad Fakhry ( right ) alleged that he was wrongfully detained on Aug 30, 2009 in the vicinity of Istana Mahkota Kubang Kerian while driving a Bentley Brooklands car.

Tengku Muhammad Fakhry claimed that he was driving the vehicle on the instructions of Sultan Ismail Petra to be sent to Singapore, but was prevented from doing so by police personnel who closed the palace gate on the orders of the second and third defendants.

The plaintiff further claimed that police personnel detained him for one hour before allowing him to go out of the palace but without the car.

Referring to the detention as mala fide and legally wrongful, he is seeking RM100 million in general damages, RM50 million in aggravated and exemplary damages, interest at a rate of four percent, costs and other relief deemed fit by the court.
