The Sessions Court in Kuala Lumpur today fixed March 11 to hear National Feedlot Corporation Sdn Bhd (NFC) executive chairperson Dr Mohamad Salleh Ismail’s application to strike out two criminal breach of trust (CBT) charges involving RM49.7 million against him.

Judge SM Komathy Suppiah set the date in chambers, during which deputy public prosecutor Azimul Azami Mohamad Nor, and counsel Muhammad Shafee Abdullah representing Mohamad Salleh were present.

When met by reporters, Azimul Azami told the court that Mohamad Salleh filed the application on grounds that the charges were invalid and void of any CBT element.

The DPP also disclosed that Mohamad Salleh, who had earlier applied to get back his passport to enable him to go for Umrah (minor Haj) on March 10, had been ordered by the court to file a fresh application for the purpose.

azlan On March 12, last year, Mohamad Salleh, 64, as a director of NFC, was charged with CBT of RM9,758,140, through four cheques for the purchase of two units in One Menerung condominium (Parcel BI-1 and B1-2), Block B in Kuala Lumpur.

He allegedly committed the offence between Dec 1 and Dec 4, 2009 at CIMB Islamic Bank Bhd in Jalan Burhanuddin Helmi, Taman Tun Dr Ismail.

On the second charge, he is accused of transferring RM40 million into the account of National Meat & Livestock Corporation Sdn Bhd, a company that he and one of his sons owned, at the same bank and place, between May 6 and Nov 16, 2009.

He allegedly committed the offence to partly finance the two condominiums.
