The High Court hearing Indonesian house maid Nirmala Bonat’s suit today allowed the application of her former employer Yim Pek Ha, to have a medical specialist examine the woman’s mental state and physical injuries.         

Judge Siti Khadijah S Hassan Badjenid allowed Nirmala to be examined in order to determine if her injuries were caused by Yim or otherwise.   

abused indonesian maid nirmala bonat 170108 yim pek ha The judge also allowed Yim ( left ), who is now serving a 12-year prison sentence after being found guilty of hurting Nirmala, to be present in court as a witness.   

On Dec 5 last year, Yim and her husband Hii Ik Ting filed an application to have a medical specialist examine Nirmala, 29, following the maid’s allegations and claims.  

The court set June 3 to 5 for the hearing.  

During today’s proceedings, Yim and her husband’s lawyer Chan Vy Sing told the court that Nirmala’s injuries and mental state needed to be examined to ascertain if it was self-inflicted or caused by Yim.

Nirmala’s lawyer M Kavimani submitted however that Yim caused hurt to the Indonesian housemaid, as held by the Sessions Court previously.  

abused indonesian maid nirmala bonat then and now 170108 On Jan 28, 2010, Nirmala ( right ) filed a suit against Yim and Hii, claiming Yim had hurt her, while Hii failed to prevent his wife from doing so and failed to provide medical treatment.  

Nirmala sought general damages for pain and suffering and more than RM40,000 for loss of income and medical expenses as special damages.   

On Oct 1, the Court of Appeal upheld a High Court decision which sentenced Yim to 12 years in prison, after she was found guilty of three counts of causing hurt to Nirmala nine years ago.
