The Kuala Lumpur High Court today fixed May 6 to hear an application to strike out the charges against former Internal Security Act (ISA) detainee Yazid Sufaat and two others.

Yazid is alleged to have promoted terrorist acts and abetted in threatening the public in Syria last year while the other two are alleged to have abetted Yazid in committing the offence.

Justice Kamardin Hashim fixed the date with the agreement of deputy public prosecutors Abdul Wahab Mohamad and Mohamad Hanafiah Zakaria and counsel for the applicants, Amer Hamzah Arshad.

The court was scheduled to hear the application today but Amer Hamzah asked for a postponement because he had just received three affidavits from the respondents (prosecution) and was awaiting two more relating to the case.

"We need time to study the affidavits handed over by the respondent today," he said.

Mohamad Hanafiah, in confirming this, said the prosecution estimated that 80 percent of the documents had been handed over and promised to meet the applicants on April 30 to finalise the issues discussed and the list of witnesses to be called.

Amer Hamzah told reporters outside the court that the application was made on the ground that the charges against his clients were mala fide and had no basis.

Yazid, 49, a canteen operator at the court complex in Jalan Duta, is charged with committing the offence at a house in Taman Bukit Ampang, Ampang, between 8.30am and 10.30am from Aug 1 to 20, last year.

He was charged under section 130G(a) of the Penal Code while Halimah and Hilmi were charged under section 109 for abetment. Both offences carry a maximum 30 years jail and fine on conviction.

They were the first individuals to be charged under the Penal Code for involvement in terrorist activities after the ISA was repealed on July 31, 2012, and replaced with the Security Offences (Special measures) Act.
