Attorney-general Abdul Gani Patail will not prosecute former Court of Appeal judge Mohd Noor Abdullah for sedition for his remarks last week, says former Kuala Lumpur CID chief Mat Zain Ibrahim.

NONE He added, the people cannot expect Gani ( right ) to initiate prosecution against Mohd Noor because the retired judge had a hand in clearing Gani and former inspector-general of police (IGP) Musa Hassan from any criminal wrongdoings in the Anwar Ibrahim "black-eye incident".

"Mohd Noor is one of the three former senior judges, appointed as members of the so-called independent panel to scrutinise the Malaysian Anti-Corruption Commission's investigation files on the allegation against Gani, Musa, Kuala Lumpur Hospital doctor Dr Abdul Rahman Yusof and myself," Mat Zain said in a statement today.

The other two members were former Federal Court judge Abdul Kadir Sulaiman and former Court of Appeal judge Mohd Noor Ahmad.

In a 2-1 majority decision, the panel cleared Gani , with Abdul Kadir, who headed the panel, dissenting.

The panel had acted following a police report lodged by PKR de facto leader Anwar Ibrahim on July 2008 over the black-eye incident.

Mat Zain said the panel's decision where Mohd Noor had ruled in favour of both Abdul Gani and Musa, in spite of the preponderance of evidence available to prove that both Gani and Musa had fabricated evidence during the 'black-eye incident' investigations.

Crusade to clear his name

The former Kuala Lumpur CID chief was speaking in his capacity as the investigating officer in the 'black-eye' investigation.

lim kit siang pc 070513 03 Mat Zain, who is on a crusade to clear his name following Anwar's police report, said he had challenged the independent panel’s decision right up to Parliament in 2011 and the records are all in the public domain , where DAP parliamentary leader Lim Kit Siang ( right ) had assisted him in his quest.

He said when the independent panel made their decision some time in September 2008, the MACC - which was then the Anti-Corruption Agency (ACA) - and Mohd Noor Abdullah had not yet been appointed to the MACC complaints panel.

“We cannot rule out the possibility that Mohd Noor Abdullah was appointed to the MACC as a reward for having ruled in favour of the attorney-general and Musa who was still the IGP then.

“I emphasise that had the independent panel - which included Mohd Noor Abdullah - made their ruling based on the facts and evidence presented before them, they would have concluded that Abdul Gani and Musa were deeply involved in the fabrication of evidence as alleged by Anwar.

Mat Zain said he is not afraid to say that there were loads of cheating, deceptions and concealment of evidence being applied to ensure that Abdul Gani and Musa were cleared from all their criminal wrongdoings in regards to the black-eye incident.

“The entire government would have collapsed otherwise,” he alleged.

mca new cabinet member 180308 chor chee heung Meanwhile, in a statement, MCA vice-president Chor Chee Heung ( right ) urged the police to prob Mohd Noor for his “hate speech” so that relevant action may be taken against the latter.

“The warnings by Mohd Noor to the Chinese community to expect a backlash from the Malays is akin to a hate speech which is meant to undermine racial harmony and national unity.

“He must be aware that Malaysia as a multi-cultural country means that everyone should help to shoulder responsibility towards fostering racial harmony and social stability instead of impeding it by his devastating words,” he said.
