Five veteran artistes today succeeded in getting a court injunction to prevent Persatuan Seniman Malaysia’s (Seniman) 15th annual general meeting (AGM) from proceeding at the Malaysian National Film Development Corporation’s (Finas) premises in Kuala Lumpur tomorrow.

High Court judge Rosilah Yop allowed the application for the injunction in her chambers in the presence of lawyer Zambri Idrus who represented the association and seven others and lawyer Wan Rohimi Wan Daud, who acted for the five.

Abu Bakar Omar, Sahlan Sudiran, Mior Ahmat Zaudi Mior Ali, Abdullah Sani and Roslinda Buang as the plaintiffs had filed the application on May 22 citing grounds that their suit against the association and the seven others had yet to be settled.

On Feb 22, they had filed the suit against the defendants claiming that Seniman’s previous AGM was not in order.  

The had named Seniman, its then-president Haron Aminar Rashid Salim or better known as Harun Salim Bachik, secretary Omar Kamarudin (better known as Yusof Kelana), treasurer Wafa A Kadir and Zed Zaidi (real name Rozaidi Abdul Jamil), who was then the deputy president, as the defendants.

The three others were Seniman executive committee members Elyas Ismail, Syed Ahmad Nahar Syed Mokhtar and Zaharudin Wahab.

They had wanted the court to declare that Seniman's 14th AGM held on May 26, 2012, the Financial Report for 2011 and minutes of the AGM, as null and void.

They claimed that besides that of the plaintiffs and defendants, there were doubts as to the legimitacy of the membership of hundreds of others who attended the AGM.

They also sought a declaration that the election of office bearers at the 2012 AGM was not valid, damages and other relief deemed fit by the court.

Besides these, they also wanted Harun Salim Bachik, Yusof Kelana and Wafa to pay RM56,000 to the association for allegedly causing it to suffer losses over a property transaction.

On Feb 28, the defendants had applied to the court to strike out the suit, claiming that according to Seniman’s articles of association, the number of plaintiffs in the case was an insufficient quorum to seek such redress.
