DAP chairperson Karpal Singh has filed an application to strike out former Ladang Paroi DAP branch deputy chairperson A David Dass' bid for an injunction to bar the party from holding its central executive committee elections on Sept 29.

Dass in his application named the party and its secretary-general Lim Guan Eng as respondents on grounds that the elections would be in breach of the party constitution.

NONE Karpal in his application argues that Dass' legal action did not stipulate any cause for his action, and that the High Court in Kuala Lumpur had no jurisdiction to hear the matter.

Hence, he said, the action was obviously unsustainable.

"Dass' application did not follow Section 18C of the Societies Act 1966, and the action should be struck off," Karpal said in his application.

He also said Section 18C of the Act states that the decision of a political party is final and conclusive.

"Hence, the decision of the party cannot be challenged, appealed or reviewed, quashed or questioned in any court for whatever reason.

"No court should have jurisdiction to decide on the application," he added in the affidavit.

The High Court has fixed Sept 25 to hear Dass' application for the injunction.
