The High Court today struck out the suit filed by two landowners against the Selangor state government, Menteri Besar Abdul Khalid Ibrahim and six others over an alleged land takeover in Ijok, Selangor.  

NONEJudicial commissioner Rosilah Yop made the decision in chambers after allowing Abdul Khalid’s application to strike out the suit.

She made the order in the presence of counsel B Thangaraj representing the two plaintiffs, namely LBCN Development Sdn Bhd and Mujur Zaman Sdn Bhd, and state legal adviser Ahmad Fuad Othman who represented Abdul Khalid (left) and the six defendants.

Thangaraj told reporters that the court struck out the suit on grounds that the matter should have been filed by way of a judicial review, and not through a civil suit.

“The court also ordered the two landowners to pay a total of RM28,000 in costs to the defendants,” he said, adding that the plaintiffs would file an appeal over today’s outcome to the Court of Appeal.

The two landowners filed the suit on Feb 21 this year, naming the menteri besar, Selangor state government, state Land and Mineral director, state land title registrar, Kuala Selangor land administrator and Menteri Besar Incorporated as defendants.

In the statement of claim, the plaintiffs claimed, among others that the defendants were aware that the property concerned had been alienated to them for the integrated Bukit Cerakah Green Revolution project and other business development projects.

They are seeking, among others, a declaration that the defendants’ decisions to claim the land in 2011 and 2012 were unlawful, void and had no legal effect.
