PAS vice-president Husam Musa’s injunction against Parpukari to bar the blogger from publishing any defamatory statements on the former Kelantan exco member stays.

This follows the Court of Appeal today upholding the Kota Baru High Court decision on April 14, which granted the injunction.

Justice Mohamad Ariff Md Yusof led a three-member bench that consisted of Court of Appeal judges Mah Weng Kwai and David Wong.

The appellate court also ordered the blogger, Mohamad Salim Iskandar, to pay RM5,000 costs.

Husam had obtained the injunction order against Mohamad Salim, 40, from repeating or publishing contents from the allegedly defamatory article titled ‘Parpukari productions mempersembahkan kisah cinta terlarang 2 benua!’ (Parpukari presents the forbidden love episode spanning two continents) dated Feb 19, last year.

On April 14 at the Kota Baru High Court, Justice Yazid Mustafa granted an injunction against Parpukari from repeating or publishing the contents of the article.

Yazid was brought in specially from Kuala Terengganu to hear the case as the two High Court judges in Kelantan had recused themselves from the hearing.

The trial for Husam’s suit against the blogger Mohamad Salim or Parpukari will begin on Jan 5.

The PAS vice-president filed the suit against Parpukari on April 25 last year and named Mohamad Salim as the owner and writer of the blog.

Husam claimed that the blogger had used a photo of him which wrongly implicated him of having an affair with another lady not his wife, and which resulted in allegations that he cannot be trusted.

The PAS vice-president also claims that the writing in the blog is also defamatory as it suggest him to be a parasite in the Islamist party.

He further claimed the article was malicious, defamatory and was directed to lower his self-esteem as a PAS leader, an elected representative and a former exco member.

It also painted a picture that he cannot be trusted, has ill morals and is a womaniser and a liar.  He claimed his reputation had been tarnished by the publication.

Husam is seeking RM5 million as damages, exemplary, aggravated and punitive damages and the injunction.

In his statement of defence, Mohamad Salim has denied he owns and runs the blog.

Husam was represented by lawyers Hisham Fauzi and Ahmad Mustaqim Zaki, while Mohamad Salim was represented by Parvinder Kaur Sandhu.
