The Federal Court in Putrajaya tomorrow will hear the final appeal of former Selangor menteri besar Dr Mohd Khir Toyo, who was convicted of corruption in the acquisition of two lots of valuable land and a mansion in Shah Alam, at a time when he had been a public servant.

The hearing of the appeal follows the Court of Appeal that had, on May 30 last year, upheld the Shah Alam High Court decision which convicted Khir.

The appellate court also maintained the 12-month jail sentence and seizure of his property. However, the court granted a stay of execution of the sentence and forfeiture of the property, pending appeal.

Khir, who had been Selangor menteri besar from 2000 to 2008, was convicted in 2011 by the Shah Alam High Court with a charge of corruption for obtaining for himself and his wife Zahrah Kechik, two lots of land and a house at No 8 & 10, Jalan Suasa 7/1L, from Ditamas Sdn Bhd director Shamsuddin Hayroni, at RM3.5 million - a lower price than the RM6.5 million Ditamas paid for it in 2004.

He is the second state menteri besar to be convicted of corruption after the late Harun Idris who was found guilty in the 1970s.

Khir will be represented by Muhammad Shafee Abdullah and M Athimulan, while DPP Masri Mohd Daud and Dasuki Ahmad are expected to lead the prosecution.

It is believed that a five-member panel will hear the appeal.

However, Justice Abu Samah Nordin would not be included, as he had chaired the Court of Appeal bench which upheld the conviction and sentence.
