Parti Keadilan Rakyat (PKR) vice-president Tian Chua and two opposition activists made another attempt to quash a sedition charge made against them over their speech at a political talk

last year.

Tian Chua, whose real name is Chua Tian Chang, Adam Adli Abd Halim and Hishamuddin Md Rais filed the application to quash the sedition charge through the legal firm of Messrs. Daim & Gamany at the High Court registry in Kuala Lumpur today.

Last Feb 18, the High Court had thrown out their application on the grounds that it was premature and had no merit.

In this second application, they are seeking an order that the charge made against them under Section 4(1)(b) of the Sedition Act 1948 be revoked because it was an abuse of the court power and breached the federal constitution.

They claimed the law was an unreasonable restriction on their rights to freedom of speech and it also breached Article 10(1) of the federal constitution.

As such, they wanted the court to acquit and discharge them of the charge.

They also applied for an order for the Sedition Act to be revoked.

In a supporting affidavit, Tian Chua described the Sedition Act 1948 as a suppression, arbitrary and extreme, as well as contradict with Article 10 of the federal constitution.

Tian Chua, 51, Adam Adli, 25, and Hishamuddin, 62, were charged with giving a seditious speech at the Kuala Lumpur and Selangor Chinese Assembly Hall at Jalan Maharajalela, Dang Wangi in Kuala Lumpur between 8.55pm and 11.15pm on May 13, 2013.

They face a fine up to RM5,000 or jail not exceeding five years if convicted under Section Section 4(1)(b) of the Sedition Act 1948.
