A businessman has filed a lawsuit against actress Zarina Anjoulie, the government and four others for negligence and fraud involving a luxury car belonging to his late father.

The suit, by Kevin Shah Kadar Shah, 33, was filed through Messrs Jeev Anand & Partners at the High Court registry on Nov 13 last year.

Besides the actress, whose real name is Zarina Anjoulie Lavocah Mohd Fahizul, and the government, Kevin Shah also named Selangor Road Transport Department (RTD) director, the Transport Ministry, dispatch clerk Salleh Idris and Public Islamic Bank Berhad as defendants.

A copy of the suit was obtained by the media today when the case came up for mention in chambers before judge Hue Siew Kheng.

Present were lawyers J Jev Anand, representing Kevin Shah; YK Leong for Salleh and federal counsel Nur Aqilah Ishak, who represented the government, the Selangor RTD and the Transport Ministry.

Nur Aqilah, when met by reporters, said the court has set April 7 to hear Kevin Shah's application to amend the statement of claim and also an application by Salleh to strike out the suit against him.

In the statement of claim, Kevin Shah stated that his late father, Kadar Shah Sulaiman, had bought a second-hand BMW car with registration number WTN 8850.

He claimed the car was registered under his father's name on May 17, 2010 after the signing of the sale and purchase agreement with Public Islamic Bank on May 11 the same year.

Kevin Shah, who is Kadar Shah's oldest child, claimed that his father had lent the car to Zarina in June 2010 and that the car remained with the actress until his father died on Nov 19, 2011.

He claimed that Zarina had never returned the car and before he could contact the woman to discuss the matter, it was re-possessed by the bank.

Kevin Shah claimed that Public Islamic Bank returned the car to him on Feb 21 last year after he paid the arrears in monthly installments, but was shocked to find that the car's registration number was BLP 8858, when his father had never applied to RTD to register any vehicle with that number.

He claimed that he was informed by the Transport Ministry, through a letter dated March 18, 2013, that the number WTN 8850 was registered to a motorcycle, bearing his father's name, while the registration number for the BMW car was BLP 8858.

He also said that RTD, through a letter dated June 3, 2013, stated that the transfer of registration numbers between the car and motorcycle was made on Feb 14, 2012, which was after his father's death.

Kevin Shah is claiming that Zarina, Salleh and the Public Islamic Bank had conspired to cheat his father by changing the registration number of the car with an intention to eliminate ownership of the car by his late father.

He is claiming general damages, interest, costs and other relief deemed fit by the court, and also a declaration that the transfer of registration number between the car and motorcycle was void.
