Punishment for 10 days' notice 'unconstitutional'

Ace: The people had won a battle but not the war. Recent cases have shown that the lower the court, the more independent and well-reasoned-out the judgment, so do not celebrate yet. The Malaysian kangaroos are still jumping around.

Fair&Just: The moon will turn blue tonight. "Once in a blue moon..." true justice prevails. The blue fair and just judges may be sidelined for future promotions. Or is it just a show or a flash of fairness and justice for US President Barack Obama to give the benefit of the doubt towards this bigotland’s human rights abuses.

Ketuanan Rakyat: Too early to say the judiciary is unbiased. Hope judges will wake up and stand their ground on laws fairly and not always side with Umnoputras and their agencies in government.

Peacemaker: Now let us all pray to Allah, Jesus, Amman, Guru Nanak, Buddha and others that there will be more fair-minded judges like today's trio of hero judges. May Allah bless them with wisdom in all their judgments and may the corrupt judges fear for their lives eternally. Amin, Amin, Amin.

Anonymous_3e21: What the rakyat asked for and been longing for all this while is an independent judiciary that is without fear or favour to any side. That is all we are asking for.

Boonpou: Who cares what Obama thinks, you Malaysians. You must be kidding me if you think Obama or any other president of the US for the past 100 years ever cared about justice in any developing country. With this unanimous decisions by the Appeal Court, we shall not be at all surprised that it will be overturned by the Federal Court. Thus is the law in Malaysia.

Do you expect any differences so long as BN is still the ruling regime? Wake up Malaysians. The day we see Malaysia having an independent judiciary is when BN is no longer the government.

Of course, it would be worse if PAS is in government. Lots of amputations, stoning to death, and what have you. Back to the Dark Ages. Do you want that to happen to us all, Malaysians? Truly Islam has been hijacked by a bunch of fanatics. It has been, for so long.

No Fool: At least this judgment is much fairer and made a lot of sense compared with a lot other judgments that are biased to serve their corrupted masters, who misuse their power to harass the opposition parties.

Fateh: Malaysia will need to restore the confidence of the rakyat and the world. Judges are playing a pivotal role and hope that this country will transform back to the good old days where judges were more upright, not corrupt, not lopsided and carried out their duty with no fear or favour. Just long for that day to return.

Justice denied: Our courts are behaving differently at different times. There appears to be rule of law but in Anwar Ibrahim’s cases, there seem to be lapses. Why? Also in the Mongolian woman’s case there seem to be lapses. Why? Why can’t we be honest?

The judgment of the Cout of Appeal will be later dismissed on appeal. All in the script already! Malaysia should be the next Hollywood, where stories in movies play out in real life in this Bolehland.

Hplooi: In any case, don't get your hopes high, because basic principles of natural justice e.g. 'beyond a reasonable doubt'; 'precedence'; 'fair hearing' are all turned on its head.

The percentage of High Court cases overturned on appeal shows some striking statistics from which you can draw reasonable assumption about the state of our judiciary.

And this is just the tip of the iceberg. And I mean the legal 'draughtsmen' who crafted revisions to Acts. Some of the revisions are so slipshod that they may be construed as unconstitutional or exceeding the limits of the original Acts.

Examples in the recent past include 'Strata Title Act', revision to the Construction Industry Development Board of Malaysia (CIDB) Act, etc. Legal draughtsmen, when crafting revisions or new Acts, are supposed to 'cover all angles'.

However, in many cases, Acts are passed without close scrutiny just on inconsistencies alone. So whither competency in our public legal service? Any wonder why we lost Pulau Batu Puteh (Pedra Bianca)?

Chris Wong: This is an important landmark decision as it tested the Peaceful Assembly Act (PAA) and would have bearing on the consitutionality of the existing clauses.

Waktamnoko: Forget the US. This nation is the world's biggest hypocrite of all. As an example - did they care about democracy in the Middle East? The US was among the biggest supporters of most of the undemocratic Arab regimes in the Middle East. Why? Because they need the oil.

They are quick to point out to your 'undemocratic' ways if they are not happy with your country's policies towards them. They are full of praises for the Mujahideens in Afghanistan but full of hatred towards the Talibans when in fact they comprise the same group of people. Why? Because the Mujahideens support them against the Russians but the Talibans are against them.

And now, some among us want the US to 'reprimand' our PM? They never said a word about the Internal Security Act (ISA) in Singapore. Why should they bother about our ISA? Wishful thinking!

Mytwosensworth: At last some wisdom. How can the people be barred from expressing their dissent through peaceful means? Can the authorities, whom the people placed in the seat of government, deny the people from giving their views on issues that they disagree with?

Only dictators will not allow this. The people must, at the least, be allowed to put their views across, regardless of whether those enthroned want to listen or not.

MinahBulat: The show is not over until the fat lady sings, this is going on appeal. The Federal Court may decide otherwise, depending on the panel.

Hmmmmmmmm: The fat lady has only just started putting on her make-up.
