Bench must explain change of judge in PM vs Mkini

YOURSAY ‘Such changes do not just happen for no rhyme or reason.’

Najib vs Mkini lawsuit sees change of judge

P Dev Anand Pillai: High Court judge SM Komathy Suppiah is a very fair and independent minded woman. Nobody can instruct her on how to decide a case.

She is what one would call a real judge . But sadly real judges are very rare in the Malaysian judiciary. Well, we all know what the outcome will be now.

Ong Guan Sin: Some pertinent record regarding Justice Komathy: when she was serving the sessions court, she denied the attorney-general's request to transfer Sodomy II against Opposition Leader Anwar Ibrahim to the High Court.

Bob: I was surprised to read that Justice Komathy was going to hear the case and I was very sure Malaysiakini will get a favourable decision. But now, it looks like all Malaysiakini readers know what the verdict is going to be.

Abasir: Such changes (the replacement of the judge in PM Najib Abdul Razak versus Malaysiakini case) do not just happen for no rhyme or reason. And anyone who has appeared before Justice Komathy would know why.

Odin: I know next to nothing about the judges in Malaysia, but if Justice Komathy is impartial and has made notable judgments as several readers here have stated, then her replacement may be one who is compliant to Umno's wishes.

Najib is sweating, what with a suit against him by private investigator P Balasubramaniam's widow and children as well as many pressing issues of which we all know about.

But there’s nothing to worry about, Malaysiakini . Right, as does goodness, always triumphs over wrong (or evil).

Gerard Lourdesamy: Malaysiakini should object to this highly irregular procedure at the High Court.

If a judge had already been assigned to the case when the writ was filed, it should not go to another judge unless the first judge has grounds to recuse himself or herself from the case.

The Chief Judge of Malaya ought to explain why this has taken place, given the personalities involved.

Inexplicable events like this tend to bring the independence of the judiciary into question.

Waktamnoko: Gerard Lourdesamy, so what's new? This changing of judges has become a normal thing in Malaysia.

Pakatan Rakyat will say that it is to ensure that the judges will rule against so and so. But then BN will also say at the same thing.

So the best bet is for Malaysiakini to just get the best legal brains to defend themselves. Whining and lamenting about such unfairness or whatever won't get them anywhere.

Tok Karut: In high profile cases like this, the Bar Council should hold a watching brief. If not, I hope Hakam and interested human rights groups would initiate the watch from the initiation of proceedings.

We are going into GE14 and these events could be instrumental in shaping the political climate for the general election.

Wrath of Altantuya: With all this evil and transparent high stakes dealing going on, it's no wonder the people has only negative comments for our government. Don't blame the people.

Homesick: Malaysiakini has lost before it even begin. Good luck Malaysiakini . I am sure most Malaysians are rooting for you.

Fair Play: Malaysiakini , it looks like the change of judge is something unexpected but not surprising. I suggest you start a crowd funding as soon as is practical.

Nil: To make things look good, the case will first go to Malaysiakini ; then comes the appeal...

Read history, Hindraf tells 'irresponsible' minister

Ksn: Persatuan Hindraf Malaysia chairperson P Waythamoorth, you are of course right about our history, what our rulers said, what the first prime minister Tunku Abdul Rahman said, and what the constitution says.

You are also right on the dot about this minister you referred to about his ignorance on history. But then what do you expect from Umno Baru ministers?

Raja Chulan: Minister in the Prime Minister’s Department Jamil Khir Baharom and many others like him have never read history books written in English.

They only read distorted or cooked-up history books. This is the result of our education system over the last three decades.

Flamescanner: Well said, Waythamoorthy. If only more ministers and ‘wannabes’ in the ruling coalition had the gumption to spell out the facts, these goons within the system will shut their gap.

FairGame: The three pillars of democracy - judiciary, executive, legislature begin to unwind and crumbled when it was ripped apart by former premier Dr Mahathir Mohamad.

Now we are witnessing the very fabric of society being abused, manipulated and torn apart by these spineless politicians.

Tan Kim Keong: "Those who will not reason, are bigots, those who cannot, are fools, and those who dare not, are slaves." - Lord Byron.

Jamil Khir falls into all the three categories.

Wira: On this issue, Persatuan Hindraf has more scrotal gumption than Pakatan Rakyat plus all BN mosquito parties.
