The High Court today struck out a suit brought by former TV3 newscaster Azrinaz Mazhar Hakim Mazhar against a restaurateur over the lease of a business outlet owned by her (Azrinaz).  

Judge John Louis O'Hara made the order in chambers in the presence of Azrinaz’s lawyer Mohd Firuz Jaffril and C Paul Aisu, who acted for the defendant, Syed Abuthahir Abdul Sithik.  

Mohd Firuz told reporters the judge had struck out an originating summons filed by Azrinaz, 35, who is a businesswoman, against Syed Abuthahir after the court was informed that Syed Abuthahir vacated the premises on Aug 20.   

He said the judge ordered Syed Abuthahir to pay RM2,000 in costs to Azrinaz ( left ).

On July 21, Azrinaz filed the originating summons seeking an eviction order against Syed Abuthahir, 37, owner of Restoran RBJ Curry House, and for him to return the leased premises.

Azrinaz, the owner of shoplot No 8, Block 4, Jalan Jalil Jaya, Jalil Link, Bukit Jalil, filed the application to obtain an order for Syed Abuthahir, the lessee of the premises since June 1, 2012, to vacate the building for allegedly breaching the terms of the sale-and-purchase agreement signed on July 11, 2012.

In a supporting affidavit filed with the originating summons, Azrinaz’s father Hakim Mazhar Mohd Johar, 66, claimed that Syed Abuthahir had failed to pay the lease of RM6,500 a month on time as per the agreement.

Hakim Mazhar, who handles the lease of the premises on behalf of Azrinaz, claimed that Syed Abuthahir had also failed to pay the electricity and water bills.

He said a notice to revoke the agreement was served on Syed Abuthahir on March 14 this year but he refused to vacate the premises.
