Counsel for the Kelantan sultan’s younger brother, Tengku Muhammad Fakhry Petra, wants to withdraw from representing the prince in his suit against the police and government over his alleged wrongful arrest.

The arrest was made as he was leaving Istana Mahkota in Kubang Kerian and heading for Sultan Ismail Petra Airport in Pengkalan Chepa, Kota Baru, Kelantan, four years ago.

High Court judge Nor Bee Ariffin fixed Sept 17 to hear the application from Messrs Nizam, Amer & Sharizad to withdraw from representing the plaintiff, Tengku Muhammad Fakhry, in the suit.

Senior federal counsel Azizan Md Arshad and Andi Razalijaya A Dadi told reporters here that Messrs Nizam, Amer & Sharizad had handed in the withdrawal notice to the court yesterday.

On May 3, last year, Tengku Muhammad Fakhry filed the suit against Musa Hassan who at the time of the incident was the inspector-general of police, the government and 13 police officers, claiming he was wrongfully arrested on May 4, 2010 while in the car at the main gate of Istana Mahkota to head for the airport.

He also claimed that some of the defendants had pointed their firearms and  shouted at him and ordered him to surrender, before taking him to the Kota Baru district contingent police headquarters (IPK) where he was detained in a room for about an hour.

The prince alleged that he was also asked to surrender his gun but he told the defendants that he did not carry it as it was left in his room at the palace.

In the suit, he also claimed that he was accompanied by policemen to Istana Mahkota to get the gun and then taken back to the IPK before being allowed to return to the palace at midnight.

He claimed he was not given food and not allowed to contact his lawyer while being held at the IPK.

Tengku Muhammad Fakhry is claiming general, special, exemplary and aggravatd damages, costs, interest and other relief deemed fit by the court.

In their statement of claim filed on July 12, 2013, all the defendants stated that only two defendants stood beside the plaintiff and that at no time did they point their weapons at the plaintiff.

The defendants also stated that the arrest was legal.
