The Court of Appeal today ordered the reinstatement of a suit by the Kampung Chubadak Tambahan residents in Sentul, who have been deemed illegal squatters by Kuala Lumpur City Hall.

The residents had applied that KL City Hall and the developer halt their project and seek compensation.

The three member bench led by Justice Abdul Aziz Abdul Rahim unanimously allowed the lawyers from PAS linked Law and Human Rights Department (Juham), who appeared for the residents, to re-instate the suit which was struck out earlier this year.

The other judges were Justice Mah Weng Kwai and Justice Prasad Sandosham Abraham.

 

Juham was represented by the chairperson of its Land and Urban Development unit, Ahmad Zamri Asa'ad Khuzaimi, a lawyer, and the head of Juham lawyers, Noorazmir Zakaria.

 

The case will now be remitted back to Kuala Lumpur High Court judge Nik Hasmat Nik Mohamad on Nov 24 for mention.

 

It was previously reported last July 1, the Kuala Lumpur City Hall, the mayor and a developer had managed to strike out the suit brought by the residents.

 

The residents had also filed an injunction to stop the City Hall from demolishing their houses.

 

However, KL mayor, Ahmad Phesal Talib had previously said that the houses of the “illegal squatters” at Kampung Chubadak Tambahan, would be demolished despite the injunction, as he claimed they had been there illegally for 20 years.

One woman namely 72-year-old Wahidah Salleh, had set up a temporary shed on Kampung Chubadak Tambahan following the demolition of houses there last month. She had also given a talk on her situation at Universiti Malaya last week.
