When A Santamil Selvi filed the RM1.9 million suit in June this year over the exile to India of her late private investigator husband P Balasubramaniam, herself and their three children, she was hoping for justice.

The five-year exile from July 2008 till 2013, followed Balasubramaniam's first statutory declaration on July 3, 2008, that implicated Najib Abdul Razak with Mongolian translator Altantuya Shaariibuu, who was subsequently found dead.

PI Bala, as he was known as, claimed he was forced to make the second statutory declaration and also hold a press conference to deny what was claimed in the first SD.

Santamil's hopes were dashed yesterday when the High Court in Kuala Lumpur struck out the suit she filed six months ago.

In her decision, Justice Hasnah Mohamed Hashim questioned Santamil's legal standing to initiate the suit as there was no letter of administration of the private investigator's estate and that the pleadings on the nine defendants were not clear.

Santamil's lawyer, Americk Sidhu, indicated yesterday he will file an appeal against the High Court decision. They have 30 days to file it.

Americk, in a statement later, said the defendants claimed there were insufficient particulars for them to respond to the allegations made and the judge agreed with them and struck out the claim.

“Let the public decide whether there are sufficient particulars in this claim as pleaded to warrant a trial and the defendants to answer these charges against them,” Americk ( left ) said, and released a copy of the statement of claim.

The defendants named by Santamil are Najib, his wife Rosmah Mansor, two of Najib's younger brothers Nazim, who is an architect and Ahmad Johari, who is a lawyer, senior lawyer Cecil Abraham and his son Sunil, carpet businessman Deepak Jaikishian, lawyer M Arumpalam, who was present at the second press conference following the second SD, and commissioner of oaths Zainal Abidin Muhayat.
