Highway concessionaire Kidex Sdn Bhd cannot say it did not miss the deadline to meet pre-conditions because the Selangor government's deadline was Feb 14 and not November as claimed, DAP's Bukit Gasing assemblyperson Rajiv Rishyakaran said.

The state cancelled its conditional approval for the Kinrara-Damansara Expressway (Kidex) yesterday, but the concessionaire said the concession agreement (CA) signed with the federal government states the deadline is Nov 14.

Rajiv said that while it is true the federal government extended its deadline to Nov 14, this does automatically mean the Selangor government's deadline of Feb 14 had changed.

“In setting these conditions, the Selangor government is within its rights to set a timeframe for the conditions to be met, the deadline of which was clearly set on the Feb 14, 2015,” he said.

Selangor Menteri Besar Azmin Ali blocked Kidex yesterday after it did not provide an independent traffic impact assessment, rate of return of the highway and toll rates and publicly-disclose the concession agreement.

Kidex Sdn Bhd yesterday said that its agreement is with the federal government, but the 14.9 kilomtere elevated highway is located in Selangor, which has jurisdiction on land matters.

It said it will wait for the Works Ministry to weigh in on the matter, while the Works Ministry said the issue will be brought to cabinet tomorrow.
