Submissions on senior lawyer Muhammad Shafee Abdullah's application for an inter-parte injunction against the Bar Council and two others will be heard by the High Court in Kuala Lumpur ‎on Tuesday.

The court also fixed the same day to hear the ‎application from the Bar Council and two others to set aside the ex-parte injunction the High Court granted Shafee on March 17.

This was confirmed this morning by the parties appearing for Shafee, the Bar Council and the two others, who are senior lawyer Tommy Thomas and former Court of Appeal judge VC George.

Shafee sought for time to respond until Tuesday, saying he needed to reply to the affidavits filed by the Bar Council, Thomas ( right ) and George.

The Bar Council, Thomas and George yesterday filed affidavits and also separate applications to set aside the ex-parte injunction.

Lawyers Kamarul Hisham Kamaruddin and Hasnal Rezua Merican appeared for Shafee.

Meanwhile, Ambiga Sreenevasan appeared for Thomas, senior lawyer Porres Royan for George and Lambert Rasa-Ratnam and Andrew Chiew appeared for the Bar Council.

Shafee had obtained an eleventh hour ex-parte injunction against the Bar Council on March 13, a day before the annual general meeting of the Bar, which was also to discuss a motion on his conduct following the conviction of Opposition Leader Anwar Ibrahim on his Sodomy II charge.

Thomas and George had tabled the motion for disciplinary action against Shafee, a senior lawyer known to be linked with Umno, the dominant BN party for the matter to be discussed in the Malaysian Bar annual general meeting.

Shafee was lead prosecutor in the Sodomy II case.

The Bar Council motion for disciplinary action filed against Shafee was for his holding of talks and press conferences criticising Anwar, after the PKR de facto leader’s jailing.

Thomas and George claimed Shafee’s actions violated Rules 5(a), 31, 32, 33 and 49 of the Legal Profession (Practice and Etiquette) Rules 1978.

Rule 5(a) states that a lawyer should not accept a case if he or she cannot be a professional, while Rule 31 states lawyers should uphold the dignity of the profession.

Thomas and George also cited Rule 33 (feelings between clients should not influence the lawyer’s conduct towards parties), and Rule 49, which states that lawyers should not ask for a matter or case to be reported.
