June 11 hearing for bid to withdraw as Azilah’s counsel

Lawyer Hazman Ahmad’s application to withdraw as Chief Inspector Azilah Hadri’s counsel in the suit filed by deceased mongolian model Altantuya Shaariibuu’s family will be heard on June 11.

High Court judge Datuk Suraya Othman fixed the date in chambers when the application was brought before her for case management today.

Meanwhile, lawyer Ram Karpal Singh ( photo ), who is representing the plaintiffs, told reporters that the court set July 7 to hear his application to amend the writ of summons and statement of claim.

“The application to amend the writ of summons and statement of claim is to import or bring in all the criminal findings for the case,” he said.

He said the court advised him to file, in the interim, an application for leave on June 11 to serve the amended application on Corporal Sirul Azhar Umar who is now in Australia.

“Since Sirul is in Australia, we need to get leave to serve the amended application on him,” he added.

Altantuya’s parents, Shaariibuu Setev and Altantsetseg Sanjaa and her two sons, Mungunshagai Bayarjargal and Altanshagai Munkhtulga, filed the suit on June 4, 2007.

They named Special Action Unit officers Azilah and Corporal Sirul Azhar, political analyst Abdul Razak Abdullah Baginda and the Malaysian government as defendants.

Abdul Razak was charged with conspiring with Azilah and Sirul Azhar to kill Altantuya, 28, in 2006.

He was acquitted of the charge in October 2008 without having to enter his defence, while Azilah and Sirul Azhar were found guilty in 2009.

On Aug 23, 2013, the Court of Appeal allowed an appeal by Azilah and Sirul Azhar and acquitted them of the charge.

However, on Jan 13, the Federal Court allowed the prosecution’s appeal and set aside the Court of Appeal's decision; it found Sirul Azhar and Azilah guilty and sentenced them to death by hanging.

Altantuya’s family, in their statement of claim, alleged that her death had caused them mental shock and psychological trauma.

They alleged that Abdul Razak conspired with the two police officers to kill Altantuya.

They further alleged that Altantuya was shot dead and her remains blown up with C4 explosive by Azilah and Sirul Azhar into pieces at a jungle at Puncak Alam, Shah Alam on Nov 7, 2006.

The plaintiffs claimed among others that as a result of Azilah, Sirul Azhar and Abdul Razak's action, they suffered anguish particularly Altantuya’s sons, who had lost their beloved mother and breadwinner.
