'Is PAS saying its clerics violated Islamic law?'
Did PAS’ ulama wing violate Islamic laws when it passed a motion to sever ties with the DAP during the party’s muktamar last week?
DAP supremo Lim Kit Siang posed this in reference to PAS' insistence that its ulama's wing's motion to sever ties with DAP was not final.
Lim pointed out that according to PAS' constitution, the finality of any motion passed at the muktamar, which is the highest decision-making body, can only be disputed if it violated Islamic law.
“Is there any complaint to the syura council that the PAS muktamar motion to cut ties with DAP without debate violates Islamic law?
“If there is a complaint that the PAS muktamar motion to cut off ties with DAP violates Islamic law, who will be the defendants – the PAS president and the entire PAS ulama leadership?" said Lim in a statement today.
Lim further pointed out that the motion was meant to be effective immediately since there was no qualifying clause subjecting it to review either by the syura council or the central committee.
The Gelang Patah MP’s remarks come after the new conservative-dominated PAS leadership said that the motion would need to be approved by the syura council and central leadership first.
Leaders from the progressive camp, however, said that the motion to cut ties with DAP was final.
Defeated leaders Mohamad Sabu ( photo ) and Mujahid Yusof Rawa have since resigned from their posts in the Penang government.
Meanwhile, Lim said he “was not aware” that the PAS central leadership could overrule the muktamar.
“This will be a contradiction in terms as it violates the PAS constitution stipulating that the muktamar is the highest decision-making body of PAS.
“Which provision in the PAS constitution gives the PAS central leadership such powers to overrule the muktamar?" he asked.
PAS’ ties with the DAP continue to sour and the syura council as well as the PAS central leadership’s decision will undoubtedly shape the future of the two parties in Pakatan.
The motion to sever ties with DAP was proposed and approved by the Ulama wing and subsequently accepted by the main muktamar body without debate last week.
