Dewan Rakyat passes 11MP without amendments

PARLIAMENT The Dewan Rakyat passed the 11th Malaysia Plan (11MP) motion without any amendments at 12.54am last night.

It provides for development expenditure of RM260 billion and is the final transformation in making Malaysia a high income developed nation by 2020.

Tabled by Prime Minister Najib Abdul Razak on May 21, it was debated for five days from May 25 before winding up by ministries for three days from June 10.

Earlier, Minister in the Prime Minister’s Department Nancy Shukri said the Attorney-General’s Chambers was reviewing Section 375 of the Penal Code to expand the definition of rape by including the insertion of objects other than genital.

Referring to a court case in Sibu, Sarawak, recently, she said negotiations were under way with stakeholders such as medical practitioners and related ministries.

“The scope of Section 375 of the Penal Code does not include the insertion of organs other than genital such as fingers,” she added.

The Sibu Court of Appeal recently freed Bunya Jalong,60, from a charge of raping a 14-year-old girl in 2011 as there was no penile penetration.

The decision was made even though DNA tests on the child born after the incident matched that of the accused.

Nancy said that rape under Section 375 of the Penal Code was defined as sexual intercourse by force or without consent of a woman.

“This includes intercourse with a woman where her approval was given due to fear, deception, misconception or not understanding its impact.”

She was answering to questions from some Members of Parliament (MP) who wanted amendments be made to Section 375 of the Penal Code.

The sitting continues today.
