The public and mass media have been ordered to refrain from making erroneous statements about the May 2, Duta-Ulu Klang Expressway (Duke) tragedy that claimed the lives of three family members.

Magistrate Noorul Fhaiez Mohd Nayan made the order which was applied for by counsel C Leo Camoens who is holding a watching brief for the victims’ family, at the Traffic Court in Kuala Lumpur today.

The lawyer had cited a Facebook posting by ‘Belia Benci Yana Familia Club’ which claimed that the case against two individuals allegedly responsible for the tragedy had already been disposed of without the police or court’s involvement.

“The statement was offensive to the victim’s family,” he said at the re-mention today of the case for two Myvi drivers Siti Noor Aini Mohd Said, 36, and Mohammad Fizal Reza Jamauddin, 31.

On May 8, Siti Noor Aini and Mohammad Fizal Reza were charged with reckless driving that resulted in the death of Fairuz Nizam Husain, 35, his wife Nova Safitri Azhari, 27, and their six-month-old daughter Nur Firuza Annisa.

Counsel Omar Bakri Ahmad and SN Seelan who represented the two accused respectively, did not object to Camoens’ application.

The magistrate set July 31 for another re-mention after deputy public prosecutor Nadia Malek Fauzie said she had not yet received the post mortem report and chemist’s report.

Meanwhile, Mohamad Yusni Husain, 49, the brother of Fairuz Nizam told reporters at the courthouse that he had lodged a police report on the Facebook statement.

Family members of the victims and accused were also present in court today.
