Deputy inspector-general of police Noor Rashid Ibrahim has said it is up to the UK court to decide on whether Sarawak Report editor Clare Rewcastle-Brown can be extradited.

"It is not up to us but (up to) their court. There will be an inquiry; we will present our case and she will have her lawyer to defend her.

"The court will decide whether or not she can be extradited; that is the process in the UK," he told reporters.

Noor Rashid ( photo ) said the Malaysian police have already stated their reasons as to why Rewcastle-Brown should be extradited.

Asked what would happen if the court decides against their application, the deputy police chief said the decision would have to be respected.

The Malaysian police have obtained an arrest warrant for Rewcastle-Brown and is working towards placing her on the Aseanapol wanted list and Interpol red notice.

She is being investigated under Section 124B and Section 124I of the Penal Code.

Section 124B states: Whoever, by any means, directly or indirectly, commits an activity detrimental to parliamentary democracy shall be punished with imprisonment for a term which may extend to twenty years.

Whereas 124I states: Any person who, by word of mouth or in writing or in any newspaper, periodical, book, circular, or other printed publication or by any other means including electronic means spreads false reports or makes false statements likely to cause public alarm, shall be punished with imprisonment for a term which may extend to five years.

Meanwhile, Rewcastle-Brown has been granted protection by the UK police.

This was after she complained of being followed and photographed in London following allegations of corruption linked to Prime Minister Najib Abdul Razak published on the Sarawak Report .
