High Court upholds fine on PKR leaders for ‘Black 505' rally

The High Court today upheld a RM1,900 fine imposed on two PKR Youth executive council members for attending a rally at an unauthorised venue in June 2013.

Judge Siti Mariah Ahmad made the decision after rejecting an appeal to enhance the fine on Mohd Nazree Mohd Yunus, 32, and Mohd Alfaizal Amjed, 34, by Deputy Public Prosecutor Ahmad Ishrakh Saad.

She said the Sessions Court judge had taken into account all the facts and complied with the principles when passing sentence on them.

On Dec 13, 2013, the Sessions Court fined Mohd Nazree and Mohd Alfaizal RM1,900 each after they pleaded guilty to speaking at a rally before heading to Padang Merbok to join others in the 'Blackout 505' rally.

They were charged with assembling in the compound of Masjid Ar-Rahman, Universiti Malaya, between 12 noon and 1.15pm on June 22, 2013 under the Peaceful Assembly Act 2012 and liable to a fine of up to RM10,000 upon conviction.
