The Magistrate’s Court today postponed to Jan 13 the hearing of student activist Adam Adli and Jingga 13 chairperson Mohd Fariz Abd Talib’s application to challenge the constitutionality of the charge against them.

The duo filed the application on Dec 17 under Section 30 of the Courts of Judicature Act 1964.

They were jointly charged on Sept 8 with participating in an illegal rally held from Sogo Complex, Jalan Tuanku Abdul Rahman to KLCC esplanade in Kuala Lumpur between 4pm and 7.30pm on Feb 28.

The charge under Section 4(2)(C) of the Peaceful Assembly Act 2012, punishable under Section 4(3) of the same act, carries a fine of not more than RM10,000 on conviction.

Magistrate Mohd Rehan Mohd Aris postponed the hearing today to allow time for the prosecution represented by deputy public prosecutor Raja Zaizul Faridah Raja Zaharudin to prepare its response to the application.

Counsel Melissa Sasidaran is representing the two defendants.
