The chief executive officer of Institut Profesional Baitulmal Sdn Bhd is seeking an injunction against the Islamic educational institute from conducting an internal inquiry on him.

Dr Syed Omar Syed Agil, 55, was appointed as CEO of the institute in July 2014. However, soon after his appointment he alleged there were discrepancies in the institution's financial affairs.

Following this, he lodged a report with the MACC on Aug 18, 2015 and with the police on Sept 1, 2015 for the institute to be investigated.

The MACC and police then stepped in to investigate the matter and classified the case as alleged criminal breach of trust under the Penal Code.

Syed Omar's lawyers consider their client as a whistleblower under the Witness Protection Act 2010 and said that he should be protected at all cost.

However, following the reports, the institute moved to hold an an internal inquiry and suspended him effective Oct 7, 2015.

In response to this, Syed Omar filed the injunction application. He is also contesting his suspension.

In his suit filed on Dec 16 last year against the Institut Profesional Baitulmal, Syed Omar seeks reinstatement as CEO, an order to quash the Oct 6 notice by the institute to hold an internal investigation, compensation following the suspension and other reliefs deemed necessary under the Witness Protection Act 2010.

The Kuala Lumpur High Court today fixed Feb 12 for the hearing of the interparte injunction and the merits of the application before Justice John Louis O' Hara.

O' Hara also granted an interim injunction against Institut Profesional Baitulmal on the suspension and ordered that the institute reply to an affidavit made by Syed Omar by Jan 12.

Institut Profesional Baitulmal is owned by the Federal Territory Islamic Religious Council.
