Former de facto law minister Zaid Ibrahim said the plight with regard to M Indira Gandhi's case is mainly on whether unilateral conversion should be allowed or condoned, more so when it involves an 11-month-old toddler.

Zaid, who was attacked by pro-Umno blog MyKMU.net today over his writings on the issue, said the blog and some Malays do not understand the real issue of the matter.

“I think this is rather unfortunate and they are getting emotional over what I wrote, wherein they (the blog and some Malays) do not understand the issue. They think just because the mother is a Hindu, regardless of the law, she cannot get custody.

“What happens if the situation is reversed. The issue is about unilateral conversion, especially if it involves the conversion of an 11-month-old toddler and the child being taken away. I think the comments made (in the blog) are irrational and showed they are emotional Malays,” he said.

Zaid said he has been called such names before, especially when he was contesting in Hulu Selangor, and remains undeterred by it.

The former minister was asked to comment on the blog's attack in an article titled ' Zaid Ibrahim Menulis Untuk Menghasut atau Ketika Mabuk ?' (Zaid Ibrahim writing to be seditious or while being drunk).

The pro-Umno blog claimed that Zaid was being emotional and his views were not based on legal principles.

It further stated that Zaid was being prejudicial to Islam and the Syariah Courts when he wrote: “They will come up with some excuses that will ultimately pass the problem to the Syariah Court. But the Syariah Court (being a religious court) will not even listen to Indira’s plea, and they have a legal right to do that. Why should they do the work of the Civil Courts?”.

The blog highlighted instances of people renouncing Islam being brought to the Syariah Court, citing the case of Siti Fatimah Tan Abdullah who wanted to leave Islam saying she never practised the religion after marrying an Iranian, Ferdoun Ashanian.

“The court allowed her application to renounce Islam and return to her religion of Buddhism,” the blog stated, adding that up to 2010 the Syariah Courts have allowed 168 applications from people to renounce Islam.

The pro-Umno portal further went on to question Zaid, whether he is still a Muslim, to which he remained unfazed as he was accused of such things before.

What the portal did not report was that Indira filed an application to review the Registrar of Muallaf's decision to issue the conversion certificate and the Syariah Court, as claimed by her lawyers and the minority judgment, does not have the powers to review.

Zaid is also being investigated for sedition and was called up on Wednesday to the Dang Wangi police station for an article which appeared in The Star , where he questioned the court's decision on Indira's case.
