Petaling Jaya Utara MP Tony Pua denies that he is a suspect in activities deemed to be detrimental to parliamentary democracy.

"I have no knowledge that the police have classified me as a suspect under Section 124B of the Penal Code for allegedly being involved in activities detrimental to parliamentary democracy,” Pua says in his affidavit-in-reply to Immigration Department director-general Mustafa Ibrahim.

This follows the department's ruling barring him from leaving the country last year.

Pua put the burden on Mustafa to prove that he is involved in activities detrimental to parliamentary democracy.

“Sometime in September 2015, I was called to Bukit Aman as a witness. I gave my statement there as a witness. Since then, I have not been called by the police or charged in court for any such allegation,” he said in his reply to Mustafa, which was filed today.

Pua had filed a judicial review application late last year to seek a certiorari to quash the decision by the Immigration Department not to allow him to leave Malaysia to attend a conference in Jogjakarta on July 22 last year.

It was reported that Pua had obtained leave (permission) for his case to be heard on its merits and following this, Mustafa and Pua submitted affidavits.

Letter from IGP

Mustafa in his affidavit dated July 15 last year stated that he received a letter from inspector-general of police Khalid Abu Bakar stating that Pua is one of those being investigated under Section 124B for activities detrimental to parliamentary democracy.

"Following that, I gave directions to the director of the security and passport division to prevent Pua from getting any immigration-related facility and it was implemented within the system," the director-general said in his affidavit.

Mustafa further reiterated that he is not obliged to tell Pua that he is on the list being investigated by the police, or that the PJ Utara MP is barred from travelling out of the country.

He further denied that Pua's rights under the Federal Constitution and his legitimate expectations rights are affected. The Immigration DG further denied that his actions are unreasonable as he was merely following instructions from the IGP.

Both Pua and Mustafa's affidavits were sighted by Malaysiakini today.

The case has fixed for mention and case management this Friday, Pua said.
