The Kuala Lumpur High Court has rejected an application by a former heir to the Perak throne to set up a Special Court to challenge the annulment of his title as Raja Kechil Besar.

Raja Izuddin Iskandar Shah had filed for a judicial review last year for the High Court to set aside the attorney-general's decision to disallow proceedings in the special court.

Judge Hanipah Farikullah today agreed with the preliminary objection raised by the AG, and thus, denied the application.

The AG had pointed out that the sultan of Perak was exercising his authority under Article 37 of the Perak constitution that grants him power over the appointment of the raja titles.

"The court is satisfied with the AG's preliminary objection. The reason is that the sultan was not acting in his personal capacity.

"He was exercising his prerogative under Article 37 of the Perak Constitution, which is not reviewable," senior federal counsel Shamsul Bolhassan, who appeared on behalf of the AG, said today.

In the preliminary objection submitted, the AG had stressed that the sultan's refusal to reinstate Raja Izuddin's title cannot be challenged as it was part of his constitutional powers.

Lawyer Mohamad Sofee Razak said he will now discuss with his client, Raja Izuddin, on the next course of action, which could include going to the Court to Appeal or pleading with the sultan of Perak.

Raja Izuddin, 63, after declaring bankruptcy in 1990, had his title stripped in 2006.

He is now seeking to have his title reinstated as he is no longer a bankrupt since 2014.

His application to get his title reinstated was rejected by the Perak sultan on April 1 last year, after which he tried unsuccessfully to get the AG's approval to initiate proceedings in the special court.
