Police officers and officers from Kuala Lumpur City Hall (DBKL), in plain clothes, were allegedly involved in a commotion during a gathering around a fountain on the crossroads of Jalan Raja Laut and Jalan Tun Perak on March 27 last year, the Magistrate's Court in Kuala Lumpur heard today.

Police officer Mohd Khairil Anwar Mansor told deputy public prosecutor Mohd Fadli Mohd Zamri that he was attached to the photography unit at Bukit Aman police headquarters and assigned to take photographs during the gathering for about five hours from 8.30pm on March 26 to 1.30am the next day.

"There were around 50 to 100 people who were gathered there... there was a crowd and people giving speeches," he said.

Khairil Anwar, however, said he was unsure on the reason for the gathering held in the run-up to the Kita Lawan rally in Kuala Lumpur that called for the resignation of Prime Minister Najib Abdul Razak.

Questioned further on what he saw at the site, he said there was a banner, but he could not recall what was stated on it.

"The gathering started out peacefully but there was a bit of commotion later," Khairil said, adding that he noted there were uniformed police and DBKL officers on duty.

Throughout the night, Khairil Anwar said he took a total of 67 photographs which were submitted to the court as exhibits.

He was the first prosecution witness to be called to testify in the case before Magistrate Nur A'minahtul Mardiah Md Nor involving two PKR state assemblypersons and four others who were charged under Section 186 of the Penal Code.

Teja state-assemblyperson Chang Lih Kang and Simpang Pulai state-assemblyperson Tan Kar Hing, were charged together with Chee Chu Sang, Yong Ming Chong, Gan Zhu Mou and N Tamilarason.

During cross-examination by defence lawyer Eric Paulsen, Khairil Anwar agreed to a suggestion that there could have been plainclothes police and DBKL officers among the gathered crowd.

On further questioning by lawyer Gobind Singh Deo, Khairil Anwar said he was at the time unaware there were plainclothes officers among the crowd.

"But you are now?" Gobind asked, to which Khairil Anwar responded, "Yes".

He also said he was unsure whether he had photographed any uniformed DBKL officers during the commotion.

The court also heard testimonies from two other police officers attached to Bukit Aman Criminal Investigation Department photography unit.

The hearing resumed at 3pm with the prosecution calling police videographer Saifulnizam Saad as their fourth witness.

Saifulnizam, who is also attached to Bukit Aman's photography unit, told the court that he was on duty together with the first witness.

"The (entire video) recording was recorded in a few parts. When an incident happened, I will start to record," he said.

Asked by deputy public prosecutor Nur Akmal Farhan Aziz on his consideration on when to start and stop recording, Saifulnizam said: "When an incident happened, I will start to record and stop when nothing is happening."

The entire video was recorded from between 9.30pm and 1.30am, he said.

He also said that he was earlier briefed on the assignment, together with Khairil Anwar, by a superior officer.

While attempting to replay excerpts from the video recording for purposes of identification, the prosecution team encountered some technical difficulties.

Nur Akmal, as such, requested for the hearing to be adjourned.

Magistrate Nur A'minahtul Mardiah granted the request and hearing will resume at 10am tomorrow morning with Saifulnizam continuing to take the stand.
